A division bench of the SHC headed by Chief Justice SHC Justice Ahmed Ali M Sheikh directed the accountability watchdog to furnish the record of the case when NAB opposed the removal of his name from the ECL.
Sharjeel Memon, former Sindh Information Minister through his counsel, prayed the court for removal of his name from ECL on the medical ground as his client wants to proceed ahead for treatment. Sharjeel Memon is an accused along with others in Rs 5.75 billion scam in provincial information department for awarding the advertisements to media in unlawful way.
Memon's counsel said that inclusion of his client name is violation of his fundamental rights of a citizen of the country. He submitted that his client was outside the country and presented himself before the law by coming back to Pakistan when the head of the bench inquired when Memon's name was added in ECL.
The Chief Justice SHC stated that the names of other accused in this case are also included in ECL. The bench also sought the details of the case from a NAB court against Zaulfiqar Shahalwani, former Sindh Information Secretary in the same case after he moved the court for a bail.
The counsel for Shahalwani submitted that three references are being heard against his client for the last three years, but no decision has come so far. The court stated that NAB court should furnish the details of the cases being heard against former information secretary and inquired why the cases have not been decided so far despite the lapse of three years. It put off the hearing of the case for March 8, 2019.
Meanwhile, the SHC rejected the bail plea of former Pakistan Peoples Party (PPP) MPA Babul Bhayo when it released the judgment on Tuesday, which was reserved on January 31, 2019. The division bench of the SHC headed by Chief Justice SHC Justice Ahmed Ali M Sheikh announced the judgment in the bail plea in which Bhayo's counsel contended that his client has been trapped without any justification.
Bhayo is accused of more than Rs40 million corruption in public money by making illegal transactions from his bank accounts. The NAB Prosecutor had opposed the bail of Bhayo by submitting before the court that there are solid evidences of corruption the accused committed.
