Justice Sheikh Azmat Saeed, heading a three-member bench, on Thursday told Barrister Ali Zafar, counsel for Bahria Town (Pvt) Ltd, "The next date (March 6) will be 'now and never.' The main issue before the court is credibility and, therefore, you have to play straight with us (SC) as we want to finalise this."
The bench was hearing the implementation of the apex court judgement on Bahria Town projects in Karachi, Murree and Rawalpindi. Ali Zafar was asked to convince on next hearing that the precinct numbers of the allotted plots do not fall in the area, which the Bahria Town claimed to have surrendered, as it was never in their possession.
Sardar Aslam Advocate earlier filed the precinct numbers along with the map of area on behalf of the proprietors of three authorised dealers of the Bahria Town namely Masoodul Ahsan Alvi of Prism Marketing, Mohammad Nadir of Messers Cosmos and Atif Ullhani of Tri-Star.
Justice Faisal Arab noted that the precinct numbers given by the dealers fall in the areas, which the Bahria Town claimed that it had surrendered. He asked from the BT counsel how much money it has taken for the land.
Ali Zafar replied that his client did not take money of the land, which it had already given up. He submitted it might be due to some confusion, adding, "Let it be rechecked if these precinct numbers fall in the surrendered area then it be will a mistake on the part of my client."
Justice Azmat remarked that for this purpose they had sought details of the allotted land. The court in the last hearing had directed the proprietors of three authorised dealers of the Bahria Town to file complete information about the total number of plots, bookings made and the total number of amounts transacted with the precinct numbers.
Sardar Aslam said that they (dealers) have sold the plots of these precinct numbers on behalf of Bahria Town. Ali Zafar contended that the map furnished by the dealers may be fake.
Justice Azmat observed it means the dealers sold the plots on unauthorised land illegally. "One of you is not making correct statement," he remarked. If it is proved then criminal case be filed against the party for making wrong statement before the highest court of the country, he added. The case was adjourned until March 6.
