Pakistan Bar Council (PBC) here on Friday decided to become party to a case on the appointment of Islamabad High Court (IHC) judges. The PBC Executive Committee attended by its Chairman Burhan Moazzam Malik and members Abrar Hassan, S M Attique Shah, Syed Qalb-e-Hassan, Muhammad Ahsan Bhoon and Muhammad Ramzan Chaudhry adopted a resolution in this regard.

The committee has authorised Vice Chairman PBC Akhtar Hussain and Chairman Executive Committee Burhan Moazzam Malik to take all necessary steps to become a party to the instant case. The PBC says in the resolution that appointment of judges in superior judiciary has many implications which require detailed consideration by all stakeholders, including judiciary, bars and the public at large. And, the executive committee of the PBC has taken the notice of a reference filed on behalf of the President Asif Ali Zardari containing questions, issues, resolutions and decisions of which will have wider implications about the interpretation of the provisions of the constitution in respect of judicial appointments.

The resolution adds that the reference would clarify the role of Parliamentary Committee and the offices of the prime minister and president. The resolution notes further that the objects of the independence of the judiciary cannot be achieved unless the appointment of superior courts is transparent and satisfactory to all the stakeholders.

It says that in order to answer the reference moved by President a special bench of the judges excluding the members of Judicial Commission should also be constituted. The resolution adds that the reference would clarify the role of Parliamentary Committee and the offices of the prime minister and president.

Being the apex body of the legal fraternity of the country, the PBC has authorised Vice Chairman PBC, Akhtar Hussain and Chairman executive committee Burhan Moazzam Malik to take all necessary steps to become party to the instant case of its nature. The resolution notes further that the objects of the independence of the judiciary cannot be achieved unless the appointment of superior courts is transparent and satisfactory to all the stake holders. It says that in order to answer the reference moved by president a special bench of judges excluding the members of Judicial Commission should also be constituted.
