Following is the text of the ordinance dated November 26, 2009 and issued here on Friday:- "Ordinance No XXXVII of 2009 AN ORDINANCE, further to amend the National Commission for Human Development Ordinance, 2002.
WHEREAS, it is expedient further to amend the National Commission for Human Development Ordinance, 2002 (XXXIX of 2002); AND WHEREAS, the national Assembly is not in session and the President is satisfied that circumstances exist, which render it necessary to take immediate action; NOW, THEREFORE, in exercise of the powers conferred by clause (1) of Article 89 of the Constitution of Islamic Republic of Pakistan, the President is pleased to make and promulgate the following Ordinance:-
1.Short title and commencement.- (1) This Ordinance may be called the National Commission for Human Development (Amendment) Ordinance, 2009.
(2) It shall come into force at once and shall be deemed to have taken effect on and from the 21st July, 2007.
2. Amendment of section 4, Ordinance XXIX of 2002.- In the National Commission for Human Development Ordinance, 2002 (XXXIX of 2002), hereinafter referred to as the said Ordinance, in section 4, for sub-section (2) the following shall be substituted, namely:- "(2) The Chairman shall, unless he resigns from the office earlier, hold office for a period of three years and shall be eligible for re-appointment for such term or terms as the President may determine: Provided that the Chairman shall cease to hold office on attaining the age of sixty-five years or the expiry of term, whichever is earlier."
3. Amendment of section 5, Ordinance XXIX of 2002.- In the said Ordinance, in section 5, for sub-section (2) the following shall be substituted, namely:- "(2) A member shall, other than the representative of the ministry of Finance, unless he resigns from office earlier, hold office for a period of three years and shall be eligible for re-appointment for such term or terms as the President may determine: Provided that the Chairman shall cease to hold office on attaining the age of sixty-five years or the expiry of term, whichever is earlier."
