The apex court on August 23 in its verdict stated that it was not an appropriate stage for it to interfere in the matter of the relevant video and its effects, particularly when the video may have relevance to a criminal appeal presently sub judice before the Islamabad High Court. The judgment also said that a criminal investigation was already being conducted into the matter by the Federal Investigation Agency.
Advocate Akram Chaudhry on Friday filed the review petition under Article 188 of Constitution read with Supreme Court Rules 1980.
The petitioner maintained that case regarding judiciary and its reputation could not be handed over to FIA or any other investigation department. He stated that the petitions were disposed of against the settled law as decided by the superior court, without even seeking reply of respondents, which was of legal significance for decision in the case.
It was requested in a petition that the top court should review its decision and order to form a commission for investigation into the matter. He said that the allegations leveled in the press conference by Pakistan Muslim League-Nawaz Vice-President Maryam Nawaz are serious in nature which aim to malign the integrity of judiciary, but nothing has been done by the state institution to probe into the matter and unearth truth leading to the restoration of sanity in the entire matter and ensuring independence of judiciary.
The petitioner maintained that the alleged author/maker of video Nasir Butt handed over forensic report of the video along with original video and device to the authorities in Pakistani Embassy in UK, adding the material must be procured by the apex court to deliver a speaking judgment. Akram Ch submitted that a magistrate in Islamabad has acquitted one Nasir Janjua and three others involved in video scam.
