The CJ rebuked additional attorney general and observed that the government wanted to paralyze judiciary. He pointed out that only four judges were working at IHC and were unable to cope with huge burden of cases. Replying to the court's query, the law officer said a bill was drafted in the light of CJP's recommendations but the opposition parties backed out and declined to support or vote in favour of the bill.
He said the government also pondered to increase number of judges through a presidential ordinance but a constitutional impediment stopped it. Under Article 89 of the Constitution, the president was barred to issue an ordinance while national assembly or senate was in session. He requested the CJP to fill three seats and added it would lessen the burden of the judges presently working in the IHC.
The CJP remarked that he might ask the SC registrar to seek explanation from the government or SC itself would take Suo motu action. The CJP also asked the law officer to come up with viable solution on next hearing after taking the issue with federal government.
