The Khyber Pakhtunkhwa government Monday moved Peshawar High Court (PHC), seeking allocation of funds and commencement of development projects on the Western Route besides provision of funds for establishment of eight industrial parks under the China Pakistan Economic Corridor (CPEC) in KP. The petition was filed by Speaker KP Assembly Assad Qaiser.

He was flanked by provincial ministers, Shah Farman, Shahram Tarakai and Atif Khan under article 199 of Constitution 1973 and made the President, Prime Minister, Secretary Planning, Development and Reforms Secretary Communication, Chairman NHA, Secretary Pakistan Railways and Finance as respondents.

The petitioner has prayed before the court to order the respondents to honour the commitments of the prime minister that he made on 28-05-2015 in All Parties Conference (APC) on CPEC, allocate funds and start development projects on western route besides provision of funds for establishment of eight industrial parks at Batagram, Manshera, Captain Karnal Sher Khan Interchange on Motorway M-I, Malakand-Chakdara Interchange, Swat, and DI Khan under CPEC as per the decision made on 15-02-2016.

The court was further requested to direct respondents to ensure provision of electricity, gas, telephone lines, fibre optics, railways lines and other relevant services to the said industrial parks besides establishment of IT development programmes at these sites.

The direction of the court was also sought to complete the feasibility and start of work on circular line from Peshawar to Nowshera, Mardan, Charsadda and back to Peshawar, western railway track from DI Khan to Peshawar, motorway from DI Khan to Peshawar and motorway from Karak to Taxila via Kohat-Jhand besides the alternate highway route from Bisham-Khawzakhela-Buner-Mardan-Nowshera-Peshawar and provision of alternate track from Gilgit to Shangla and Dargai via Shandur.

The railways line from Dargai to Nowshera, already in existence, is being improved and up graded besides alternate route to Karakuram Highway (KKH) from Gilgit-Chitral, Chakdara-Peshawar-Kohat-DI Khan-Zohb and Quetta. The Speaker has also requested the court to direct the respondents to make commitment that the western route shall receive the same quantum of funds being spent on eastern route and the share and development funds of western route shall in no way be allowed to be usurped by the eastern route.

Flanked by Provincial Ministers Shah Farman, Atif Khan and other PTI stalwarts before submitting the constitutional petition, the Speaker KP Assembly Asad Qaiser said he was the custodian of the assembly which represented the collective will of the people of the province and was fully bound to follow unanimous resolutions passed by the assembly.

He said when CPEC was announced in April 2015, the KP Assembly passed two resolutions (No 663 and No 679) welcoming the CPEC agreement, urging the Federation to give due share of development to the western route.

The Speaker said "we are not against the CPEC but wanted due share of KP province in this project of immense importance." He said the commitments of the Prime Minister made during the APC should be honoured and all facilities like fibre optics, railway tracks should be provided to the western route.
