A three-member Supreme Court bench headed by Chief Justice Iftikhar Muhammad Chaudhry in rental power verdict implementation case on Thursday observed that a parliamentary system was flourishing in the country as elections were to be held after completion of a five-year tenure of the Parliament, adding that there should be no fearful or uneasy anticipation of the future or apprehension of any perceived or real threat to democracy as expressed by a highly reputed Parliamentarian (Senator Raza Rabbani).

The court further said the executive - both civil and military - "shall" not take any action on the basis of the highly objectionable letter that the NAB chairman, Admiral Fasih Bokhari (Retd), had written to President Asif Ali Zardari, saying any deviation from the constitution or introducing any other system would be against the constitution.

During the course of proceedings, the Chief Justice observed that people were fully aware of the happenings of November 3, 2007 wherein an important matter was pending before the court while a bench was seized with the matter of qualification of General Musharraf (Retd); to contest election in uniform but later on an emergency was imposed on the country. He maintained that a restraining order was passed by a seven-member bench, and later on judiciary was restored.
