A bench headed by Justice Anwar Zaheer Jamali and comprising Justice Khilji Arif Hussain‚ Justice Asif Saeed Khan Khosa‚ Justice Ejaz Afzal Khan and Justice Ijaz Ahmed Chaudhry retracted the contempt notice. During the course of hearing, Naek apprised the bench that the government had fully complied with court's directives strictly in accordance with the NRO judgement and a letter was sent to Attorney General Geneva in English and French languages.
Naek urged the court to dismiss the instant matter. Justice Anwar Zaheer Jamali acknowledged that the government had complied with court's directives to write to Swiss authorities to revive graft cases against President Asif Ali Zardari. The court also gave time to National Accountability Bureau (NAB) to revisit its stance over investigation against former Attorney General for Pakistan Malik Qayyum as well as other NRO beneficiaries including Ahmed Riaz Sheikh, former Additional Director FIA, and former MD OGDCL Adnan Khawaja in light of Asghar Khan and Anita Turab verdicts in which bureaucracy had been asked not to follow illegal orders of their superiors.
The court observed that it would issue a more appropriate order regarding disposal of the matter in the next date of hearing. Later, talking to the media persons outside the Supreme Court, Federal Law Minister stated that the court's decision was a victory for justice and democracy. He added that the letter dispatched to the Swiss authorities made it clear that graft cases could be revived but the President enjoyed immunity under Pakistani as well as international laws. Subsequently, the bench adjourned the hearing relating to NRO beneficiaries including Ahmed Riaz Sheikh and Adnan Khawaja till December 04.
