The court also directed the petitioner to produce the press clippings, which show that Dr Aafia was abducted from Karachi and the court also asked him to produce the decision of South Africa highest court, which had directed the government to get back their citizen back from America.
Earlier, a Deputy Attorney General Naveed Inayat Malik while producing the treaty documents, reiterated before the court that the government could not approach the ICJ on its own for the release of Dr Aafia. He was of the view that Pakistani government was in an agreement with US which restricts it from doing so.
The DAG also reiterated his stance that Dr Aafia was arrested by US forces from Afghanistan and Pakistan had no role in her arrest and extradition. The petition was filed by Barrister Javed Iqbal Jaffree submitting that the court had earlier directed the government to take action for the release and repatriation of Dr Aafia but it did not comply with court orders. He said the court had also asked the government to move ICJ for the release of Dr Aafia but the government remained failed.
Barrister Iqbal said the government engaged a panel of US lawyers on a hefty fee for contesting case of Dr Aafia but did not bother to move ICJ which cost nothing. He prayed to the court to initiate contempt of court proceedings against respondents for defying court orders.
