Chief of Army Staff has amended the Provisional Constitution Order No 1 of 2007 to confer powers on the President to amend or repeal the PCO and revoke the Proclamation of Emergency of the 3rd November 2007 on such day as he may deem fit.

General Pervez Musharraf had issued the PCO as Chief of Army Staff and not as the President of Pakistan. Analysts say that President Musharraf after relinquishing the charge of COAS will continue to have the powers to amend and repeal the PCO and revoke the proclamation of emergency in the country.

The order to amend the Provisional Constitution Order 2007 says: WHEREAS it is expedient to amend the Provisional constitution Order No 1 of 2007 for the purposes hereinafter appearing. NOW, THEREFORE, in > from page 1 pursuance of the Proclamation Emergency of the 3rd day of November, 2007 and in exercise of all powers enabling him in that behalf, the Chief of Army Staff is pleased to make and promulgate the following Order.

(1) This Order may be called the Provisional Constitution (Amendment Order, 2007). (2) It shall come into force at once and shall be deemed to have taken effect on the 3rd day of November, 2007.

In clause (1) of Article 2 of the Provisional Constitution Order No 1 of 2007, in the first proviso, after the word "Constitution" the words "and amend or repeal this Order" shall be inserted. In the Provisional Constitution Order No 1 of 2007 after Article 5 the following new Article shall be added, namely: "6 The president may revoke the Proclamation of Emergency of the 3rd day of November, 2007 on such day as he may deem fit".
