In a major policy shift, Pakistan will sign an agreement with Turkish government to deport Pakistanis who try to sneak illegally into Europe with the help of human smugglers, sources in Interior Ministry told Business Recorder.

They said that a draft 'readmission agreement', to be signed between the two countries, has been examined in inter-ministerial meetings, attended by representatives of Ministries of Foreign Affairs and Law, who cleared the proposal.

"Negotiations with Turkish officials on the proposed 're-admission agreement' have been started," sources said, adding that it would be the second such agreement after Britain.

Sources said that the contacting parties would set up a joint committee of experts to work out modalities of the agreement before its implementation.

The Article IV of the agreement, a copy of which was made available to this scribe, suggests that the requesting contracting parties would bear the transport costs of the persons up to the border of the state of the requesting country.

The requesting country will allow the persons, subject to a re-admission procedure, to transport to the state of their destination with all belongings legally acquired, according to the current national legislation, the draft agreement said.

Decision on re-admission will be taken as soon as possible, but not later than 15 days following the receipt of the readmission request. The return and re-admission will take place within 10 days after the positive response of the requested country at the designated entry points, airports or ports, and will be confirmed by drawing up an official report, said an official.

He said that processing of personal data would only take place if such processing is necessary for implementation of the agreement by the 'competent authorities' of Pakistan and Turkey.

Sources said that personal data would be collected for specified, explicit and legitimate purpose of implementing the agreement and there would be no further processing by the communicating authority or by the recipient in a way incompatible with that purpose.

The MoU shall not apply to persons subject to procedures related to extradition, extradition in transit or transfer of convicted persons as agreed upon between the two countries or between and third parties.
