An Appellate Bench of the Sindh High Court (SHC) for accountability courts comprising Justice Mohammad Mujeebullah Siddiqui and Justice Mohammad Afzal Soomro on Monday allowed an appeal preferred by convict Maqsood Ahmed in Thatta Cement Factory case.

The appellant impugned judgement by the Accountability Court (ACC-I) which sentenced the appellant to serve a three-year term and pay a fine of Rs 17,890,200. In case of default, the appellant was ordered to serve Simple Imprisonment for one-year.

When the appeal came up for hearing, the counsel for the appellant submitted that the same illegality was committed at re-trial and Prosecution Witness 1-4 were examined in the absence of accused/appellant.

The counsel also submitted that main accused Syed Riaz-ul-Hasan Rizvi was acquitted by the trial court.

The bench perusing the case papers and judgements, allowed the appeal setting aside the conviction and sentence awarded to the accused. According to prosecution, accused/appellant in collusion with main accused caused a loss of Rs 41.19 million to the Thatta Cement in 1996.

The same court also admitted an applicant Anwar Yousuf Raza to interim pre-arrest bail against a solvent surety of Rs 0.3 million. The applicant, a property dealer, was accused of bank fraud with purchaser of two plots in DHA.
