The suits were filed by Anjuman-e-Masjid New Town Karachi against Maulana Mufti Ahmed-ur-Rehman and vice versa. Maulana Ahmed-ur-Rehman in his suit prayed to the court to declare and issue permanent injunction against Maulana (Late) Mohammed Yousuf Binori and others.
The plaintiff maintained that the trust for the mosque and madressa was illegally established by late revered religious scholar who acted beyond his jurisdiction and powers, as he was an employee of the madressa of Binori Town.
In the other two suits filed by Maulana Mohammed Yousuf Binori it was maintained that the Maulana never remained an employee.
Instead, he had established madressa from his own efforts, never took any salary from the subscription and all construction of the mosque was raised through donation from the philanthropists.
The madressa was established in a single room and was expanded to the present big building due to efforts by late Mualana Mohammed Yousuf Binori, it added.
When the case came up for hearing today, the parties exchanged list of witnesses and other documents related to the controversy.
The list included Maulana Fazlur Rehman of MMA, Hafiz Hussain Ahmed of JUI, Mufti Nizamuddin Shamzai, Maulana Abdul Razzak Iskander, Maulana Mohammed Anwar Badakhshani, Haji Anis-ur-Rehman Kalia, Mufti Mohammed Zaroli Khan, Maulana Manzoor Ahmed Chinioti, Qari Saeed-ur-Rehman and others on behalf of Maulana (Late) Mohammed Yousuf Binori.
